TERMS AND CONDITIONS:
HIRE AGREEMENT TERMS AND CONDITIONS (Valid February 1st 2009 - March 31st 2010):
Welcome and thank you for choosing Sundowner Campervan Hire. We are very proud of our product and specialise in a personalised service. Our greatest concern is that you enjoy your holiday and return home safely. So to assist you in making your holiday a wonderful experience it is important for you to carefully read the following terms and conditions.
IDENTIFICATION:
A 100 point identification check is required on collection
of a vehicle.
Example: A current valid Drivers Licence = 40 points, plus a Passport = 70
points, or a Birth Certificate = 70 points is acceptable.
DRIVERS LICENCE AND AGE QUALIFICATION:
A current valid "A" class standard drivers licence, or an international drivers licence of the equivalent standard is required. Drivers must be 25 years of age or over.
INSURANCE:
All vehicles are comprehensively insured
for damage to the vehicle or to the property of a Third Party. The hirer is
responsible for the first AUD$500 (“the excess”) of the cost
of damage to Third Party property or to the rented vehicle, including single
vehicle accident, windscreen and tyre damage, towing and recovery costs, theft,
fire, break-in or vandalism with the exception of the ‘exclusions’.
This also includes the cost of the daily rental for the period the vehicle
is off fleet for accident repairs.
The excess is held as part of the bond, and is forfeit in the event of an accident,
regardless of who is at fault.
The excess will be refunded if Sundowner is successful in recovering the cost
of the damages from the Third Party. Please note that Third Party claims can
take months to resolve.
The excess applies in respect of each claim, not rental.
Personal injury is covered in most cases through Registration third party insurance. However we strongly recommend that all people travelling in Australia take out Personal Travel Insurance. Sundowner does not accept any liability for personal injuries sustained during hire. Sundowner also accepts no liability for any loss or damage to personal belongings during hire.
EXCLUSIONS:
Insurance is void and the client hirer is fully liable for
any damage to the Sundowner Campervan Hire vehicle and accessory equipment
if any of the following conditions occur. The following conditions are also
exclusive of the Bond.
a) The terms of the hire contract are breached.
b) Damage to the vehicle is caused by careless, wilful or reckless driving
or behaviour.
c) Driving under the influence of drugs or alcohol.
d) Driving on restricted roads.
e) The cost to retrieve or recover a vehicle, which has become bogged.
f) The cost to replace keys, which have become lost, stolen, or retrieval
of keys, which have become locked in the vehicle.
g) For any costs relating to overhead or under body damage however caused.
h) Water submersion or salt water damage caused through own fault.
CREDIT CARDS
The credit card holder will be jointly and severally liable as a customer. Accepted credit cards are Visa Card and MasterCard. A non-refundable 1.75% administration fee will apply to all Visa and MasterCard transactions.
BOND:
A bond of AUD$1000 applies to all Sundowner Campervan Hire
vehicles. The bond is fully refundable provided the vehicle is returned on
time, to the correct location, undamaged in clean condition and with a full
fuel tank of diesel. Up to this is the amount payable in the event of:
a) Accidental damage caused to the vehicle whilst on hire.
b) The vehicle being returned in an unclean condition.
c) A motor vehicle accident.
d) Accessory equipment being lost, stolen or damaged.
e) Toilet cassette and grey water tank is not empty on return of vehicle.
f) Diesel fuel is not topped up on return of vehicle.
DEPOSIT:
Bookings are only confirmed by payment of a deposit of AUD$1000. The full amount due for the hire period is payable prior to commencement of the hire. This payment can be paid in cash, EFTPOS, credit card (fee applies for credit card payments). A cheque is also acceptable, but must be received 7 days prior to commencement of the hire.
ROAD RESTRICTIONS:
Sundowner Campervans can only be driven on Sealed / Bitumen or access roads.
REPAIRS:
Repairs of up to AUD$100 may be affected without authorisation and will be reimbursed after receipts have been shown. Amounts above AUD$100 require authorisation from Sundowner Campervan Hire.
INFRINGEMENTS:
Any traffic infringements for example, speeding, failing to
indicate, parking, tollway fines etc, or accidents including third party property
damage must be reported to Sundowner Campervan Hire. Any residual fines or
costs becoming apparent after the hire period will be redirected to the client,
and an administration fee of AUD$50 per fine may apply.
Infringements are also exclusive of the Bond.
MOTOR VEHICLE ACCIDENTS:
In the event of a motor vehicle accident occurring whilst
on hire, the customer must follow the following procedure:
1) Obtain the names and addresses and vehicle registration numbers of third
parties and any witnesses.
2) If possible, photograph damage to all vehicles and registration numbers.
3) Report the accident to the police, regardless of estimated damage costs.
4) Contact Sundowner Campervan Hire as soon as possible within 24 hours of
the accident occurring with the accident details.
ON ROAD ASSISTANCE:
Nation wide roadside service is provided thru RAC. Any problems associated with the vehicle, including equipment failure must be reported to Sundowner Campervan Hire as soon as possible within 24 hours, in order to give Sundowner the opportunity to rectify the problem as quickly as possible. Failure to contact Sundowner within 24 hours may compromise any claims for compensation.
MINIMUM HIRE:
A minimum hire duration of 5 days applies to all Sundowner
Campervan hires. (10 days over Christmas New Year)
The day of the vehicle collection is counted as day one regardless of collection
time. The day of the vehicle return is counted as the final day regardless
of return time.
ONE WAY HIRE:
By negotiation.
HIRE EXTENSION:
Hire extension requires authorisation from Sundowner Campervan Hire, is subject to vehicle availability and must be paid for in advance.
TERMINATING THE AGREEMENT AND REPOSSESSING THE VEHICLE:
The customer acknowledges that Sundowner Campervan Hire may
terminate this agreement and repossess the vehicle, and for that purpose enter
upon any premises and remove the vehicle at any time, without notification
to the customer, and that the customer will pay the reasonable costs of repossessing
the vehicle, including towing charges if:
a) The terms and conditions of the hire contract have been breached.
b) The customer has obtained the vehicle through fraud or misrepresentation.
c) The vehicle has not returned on the agreed date, or Sundowner Campervan
Hire reasonably believes that the vehicle will not be returned on the agreed
date.
d) Sundowner Campervan Hire considers on reasonable grounds, that the safety
of the passengers or the condition of the vehicle has become endangered.
The customer understands that in the event of such termination or repossession,
the customer has no right to a refund of any part of the Hire Charges or Bond.
RELEASE AND INDEMNITY OF SUNDOWNER CAMPERVAN HIRE:
The customer releases Sundowner Campervan Hire, its employees and agents, from any liability to the customer (regardless of who is at fault) for any loss, damage, demands and expenses including legal costs incurred or sustained by them by reason of the customers hire, use and/or possession of the vehicle.
ENTIRE AGREEMENT:
This agreement constitutes the entire agreement of the parties and there are no other oral undertakings, warranties or agreements between the parties relating to the subject matter of this agreement.
